When you take part in Fairtrade Consultations, personal data and business sensitive data are collected from you. This personal information may include information necessary for you to access Fairtrade Consultations, or information that may be required to accommodate your preferences, or information that you provide us with through the contact options.

The protection of your personal data and of your organization’s data are important to us. Your data will be protected in accordance with the law. This is guaranteed by an external data protection officer.

Below you will find information about which data is collected when using Fairtrade Consultations and how that data are used.

2. Collection and storage of personal data as well as the nature and purpose of their use when visiting the website

When you visit our website https://consultation.fairtrade.net, the browser used on your device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information will be collected without your intervention and stored until automated deletion:

  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the retrieved file,
  • website from which access is made (referrer URL),
  • the browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The data mentioned are processed by us for the following purposes:

  • ensuring a smooth connection of the website,
  • ensuring comfortable use of our website,
  • evaluation of system security and stability as well
  • for further administrative purposes.

The legal basis for data processing is Art. 6 (1) lit. f of the General Data Protection Regulation (“GDPR”).


3. Collection and storage of personal and business sensitive data as well as the nature and purpose of their use when using Fairtrade Consultations

You can register on our website for our Fairtrade Consultations program. As part of the registration process, you will be required to provide the following information:

Fairtrade Consultations requires you to provide the following personal information in order to receive a secure link:

  • Full name
  • Email address
  • (where applicable) FLOID

This data is processed by us for the following purposes:

  • To provide a bespoke view of the consultation questions. For example, where a FLOID is given, your Country will be filled automatically.
  • To enable you to save your progress and to return later to finish and submit the consultation
  • To enable us to follow up on responses with you directly
  • To enable us to provide feedback to you and your organization on the outcomes of a consultation
  • To enable us to filter results by country or region and to follow up on regions with low engagement
  • To enable us to notify you of new or upcoming consultations
  • To provide support should technical issues arise

Where you expressly give us your consent, we process your personal data as described above on the basis of that given consent (Art. 6 (1) lit. a GDPR). In any other case, the legal basis for the processing of your personal data is our legitimate interest (Art. 6 (1) lit. f GDPR) in facilitating and following up on your participation in Fairtrade Consultations and in informing you about new or related consultation opportunities.

Once you have provided the required information, you will receive a secure link to our Fairtrade Consultations platform. After clicking on the secure link, you may voluntarily provide the following information:

  • Company name and address
  • Your position or responsibility within the organization
  • Your responsibility within a supply chain
  • Your gender or a breakdown of the gender of your staff (in ratios)
  • Your main Fairtrade products
  • The sales volumes bought or sold of these Fairtrade products
  • Costs associated with your products, this may include wages or labour costs
  • Details about other products bought or sold

All information we receive from respondents will be treated with care and kept confidential. Results of this consultation will only be publicly communicated in aggregated form. All feedback will be analysed by the Fairtrade Consultations Project Team, and this analysis will be used to draw up conclusions or final proposals. When analysing the data we need to know which responses are from producers, traders, licensees, etc. and we need to be able to analyse this data in a disaggregated manner in order to correctly identify trends and to follow up if questions arise. For this reason, so we kindly ask that you provide us with information about your organization. A Fairtrade Consultation Project Team is made up of staff within members of the Fairtrade System who have expertise about the subject that is under Consultation. This often includes staff from Producer Networks and National Fairtrade Organisations. Members of this project team sign a non-disclosure agreement before gaining access to your data as needed.

The processing of the information you voluntarily provide as part of the consultation is based on Art. 6 (1) lit. f GDPR. The processing is necessary for the purposes of our legitimate interests in conducting meaningful and structured stakeholder consultations, enabling differentiated analysis of responses (e.g. by type of organisation, region or role within the supply chain), and deriving well-founded conclusions and proposals. These interests are balanced against your interests by ensuring that the provision of such information is voluntary and that results are only published in aggregated form.


4. Disclosure of data

A transfer of your personal data to third parties for purposes other than those listed below does not take place. We only share your personal information with third parties if:

  • you have given express consent to this according to Art. 6 (1) 1 lit. a GDPR,
  • disclosure pursuant to Art. 6 (1) lit. f GDPR is required to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,
  • disclosure pursuant to Art. 6 (1) lit. c GDPR is a legal obligation, as well as
  • this is legally permissible and according to Art. 6 (1) lit. b GDPR is required for the settlement of contractual relationships with you.

Our legitimate interest follows from the data collection purposes listed above. We never use the collected data for the purpose of drawing conclusions about you. In addition, we use cookies and analysis services when visiting our website. Further explanations can be found under no. 9 and 10 of this Privacy Policy.


5. Data subject rights

You have the right:

  • in accordance with Art. 15 GDPR, to obtain information about your personal data processed by us. In particular, you may provide information on the processing purposes, the category of personal data, the categories of recipients to whom your data has been disclosed, the planned retention period, the right of rectification, erasure, restriction of processing or opposition the existence of a right of appeal, the origin of their data, if not collected from us, and the existence of automated decision-making including profiling and, if necessary, meaningful information about their details;
  • in accordance with Art. 16 GDPR, immediately demand the correction of incorrect or complete personal data stored with us;
  • in accordance with Art. 17 GDPR, to seek the cancellation of your personal data stored by us, unless the processing for exercising the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of the public interest or for assertion, Exercise or defense of legal rights is required;

6. Right to object

If your personal data are based on legitimate interests in accordance with Art. 6 (1) lit. f GDPR are processed, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct mail. In the latter case, you have a general right of objection, which is implemented by us without specifying any particular situation. 7. Data security

We use the popular SSL (Secure Socket Layer) method within the site visit, in conjunction with the highest level of encryption supported by your browser. We also take appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
